Republican strategist and conservative writer Michael Johns, a former White House speechwriter and Heritage Foundation policy analyst, will discuss "The Conservative Path to Victory" this evening, July 17, 2008, at 8pm EDT/5pm PDT, on BlogTalkRadio's "Patriot Action with Wyatt and Matt." Johns has said that he believes that, over the past several weeks, the American electorate is beginning to awaken to the fact that the most thoughtful solutions to America's policy challenges are coming from conservatives. He has further said that he believes this September's Republican National Convention will further highlight the dynamism of these solutions and the fact that it is only a liberal stronghold on the U.S. Congressional leadership that is prohibiting many of these initiatives from being rapidly enacted.
Johns has 20 years of industry, governmental and public policy experience, having served in the White House, the United States Senate, and for the former Governor of New Jersey and one of the world's premiere public policy research institutes. He has written on public policy issues for The Wall Street Journal, The Christian Science Monitor, National Review, Policy Review and other publications and has discussed these topics on CNBC, C-SPAN, Fox Morning News, PBS, and other television and radio media. He also is the author of an influential conservative public policy blog.

I get too many newsletters. Back a couple of weeks ago, I wrote an article titled 'A Nation at War with Itself' It would have been nice to have read this article by Newt Gingrich to include a few points about how the war is being fought. I suppose I could call this a supplemental post, but the newsletter was there sitting in my inbox the whole time. This happens on a regular basis, but more so in the last month or more. I've addressed, so I should be able to do a better job of it now. I've posted the article here so you can read it for yourselves.
Judges overstepping their authority is nothing new. Newt informs us of the historical precedence of the presidential powers combining with the legislative powers to set them straight on their job description as I described in the original post. He specifically cites a case pertaining to Habeus Corpus and presidential authority to make policy in regard to enemy combatants. This authority may not be popular with the America hater crowd, but it is essential to the war effort. Since we do have a fifth column seated in Congress and since the MSM is complicit with enemies of the state and since the term is coming to an end for the current president, he will not be the presiding president over the correction of the judicial authority. Will the maverick do it? Probably. Depends on how far they go during his tenure.
Congress and the President Need Not Acquiesce to a Tyrannical Court
There is significant precedent in American history for believing that the legislative and executive branches can act to restrict the reach of judicial decisions as well as force the judicial branch into changing its views when they are out of touch with the constitutional values, practices, and traditions of America.President Thomas Jefferson and the Jeffersonians successfully fought back against the Federalists' use of the courts to impose their agenda over the will of the people. After the Federalists lost the election of 1800, but before the new Jeffersonian congressmen took office, the Federalists more than doubled the number of federal circuit judges (from seventeen to thirty-five) and packed them with loyal Federalists. The Jeffersonians reacted by simply eliminating all eighteen new federal circuit court judgeships.
President Abraham Lincoln refused to treat the Dred Scott decision, which both declared unconstitutional a federal law that had limited the extension of slavery and that blacks were not citizens under the Constitution, as legally binding on the executive branch. For example, his administration issued U.S. passports to free blacks and signed legislation that placed restrictions on slavery in the federal territories, positions at odds with the Dred Scott decision.
And in June 1942, when German spies who had landed in the U.S. to carry out acts of industrial espionage were captured by the FBI, President Franklin D. Roosevelt acted swiftly to signal to the Supreme Court that he was not going to entertain court intervention. First, FDR issued an executive order on July 2, 1942 that the detainees were to be subject to trial immediately by military commission. FDR also made clear to his attorney general what his reaction would be to any writ of habeas corpus: "One thing I want clearly understood . . . I won't give them up . . . I won't hand them to any United States marshal armed with a writ of habeas corpus." FDR understood the Supreme Court was supreme in the judicial branch but it was not supreme over the other two political branches.

reestablish a constitutional balance among the three branches. I will

Let's do it again: When will Bush stop lying about the link between Iraq and 9-11?
Can some conservative hacks out there please tell me why our president continues this lie? I mean, it's been disproven time and time and time again, yet we keep hearing the same thing. What is wrong with this administration? What is wrong with the American people that we haven't demanded his removal from office? He is lying about the reasons we are sending our troops to DIE. To DIE! He's not lying about who gave him a hummer in the Oval Office. He is lying about the reaons we are killing Iraqis and seding our soldiers to DIE.
Damn he ticks me off!
And we are going to have this argument until one of you conservative hacks can give me a legitimate reason based on truth and fact and not simply regurgitating the lies being fed out of the White House.

And I have no problem going after the guy who actually attacked the US. Remember bin Laden? The guy in his cave making movies every other week? Let's get him and if he implicates others, then we go get them. Instead Bush and Cheney lie, lie, lie, lie to start an unecessary and unjust war when we had a necessary and just war that hasn't been finished yet. If we have to kill some people, let's at least kill people in the right country. Is that too much to ask?

On August 20, 1998, President Bill Clinton ordered a cruise missile attack against a chemical weapons factory in Sudan. The cruise missle strike was in retaliation for the August 7, 1998 truck bomb attacks on U.S. embassies in Tanzania and Kenya which killed more than 200 people and wounded more than 5,000 others. The chemical weapons factory in Sudan was funded, in part, by Osama bin Laden who the U.S. believed responsible for the embassy bombings. Richard Clarke, a national security advisor to President Clinton, told the Washington Post in a January 23, 1999 article that the U.S. government was "sure" that Iraqi nerve gas experts had produced a powdered substance at that plant for use in making VX nerve gas. link
On August 25, 1998 the Fort Worth Star-telegram reported a link between Iraq and the Sudanese chemical weapons factory destroyed by the United States in a cruise missile attack. The chemical weapons factory was hit because of links to Osama bin Laden who the U.S. believed responsible for the recent embassy bombings. A senior intelligence official said one of the leaders of Iraq's chemical weapons program, Emad al-Ani, had close ties with senior Sudanese officials at the factory. The intelligence official also said a number of Iraqi scientists working with al-Ani attended the grand opening of the factory two years earlier. Emad Husayn Abdullah al-Ani surrendered to U.S. military forces on April 18, 2003. link link
On November 5, 1998 a Federal grand jury in Manhattan returned a 238-count indictment charging Osama bin Laden in the bombings of two United States Embassies in Africa and with conspiring to commit other acts of terrorism against Americans abroad. The grand jury indictment also charged that Al-Qaeda had reached an arrangement with President Saddam Hussein's government in Iraq whereby the group said that it would not work against Iraq, and that the two parties agreed to cooperate in the development of weapons. link link
On January 11, 1999, Newsweek magazine ran the headline "Saddam + Bin Laden?" The subheadline declared, "It would be a marriage made in hell. And America's two enemies are courting." The article points out that Saddam has a long history of supporting terrorism. The article also mentions that, in the prior week, several surface-to-air missiles were fired at U.S. and British planes patrolling the no-fly zones and that Saddam is now fighting for his life now that the United States has made his removal from office a national objective. link

Carlos the Jackal, Abu Nidal, Abu Abbas, the most notorious terrorists of their era, all found shelter and support at one time in Baghdad. On February 13, 1999, CNN reported, "Osama bin Laden, the Saudi millionaire accused by the United States of plotting bomb attacks on two U.S. embassies in Africa, has left Afghanistan, Afghan sources said Saturday. Bin Laden's whereabouts were not known....." The article reports, "Iraqi President Saddam Hussein has offered asylum to bin Laden....." link
On February 18, 1999, National Public Radio (NPR) reported, "There have also been reports in recent months that bin Laden might have been considering moving his operations to Iraq. Intelligence agencies in several nations are looking into that. According to Vincent Cannistraro, a former chief of CIA counterterrorism operations, a senior Iraqi intelligence official, Farouk Hijazi, sought out bin Laden in December and invited him to come to Iraq." NPR reported that Iraq's contacts with bin Laden go back some years, to at least 1994, when Farouk Hijazi met with bin Laden when he lived in Sudan. link link
On February 14, 1999, an article appeared in the San Jose Mercury News claiming that U.S. intelligence officials are worried about an alliance between Osama bin Laden and Iraqi leader Saddam Hussein. The article states that bin Laden had met with a senior Iraqi intelligence official near Qandahar, Afghanistan in late December 1998 and that "there has been increasing evidence that bin Laden and Iraq may have begun cooperating in planning attacks against American and British targets around the world." According to this article, Saddam has offered asylum to bin Laden in Iraq. The article said that in addition to Abu Nidal, another Palestinian terrorist by the name of Mohammed Amri (a.k.a. Abu Ibrahim) is also believed to be in Iraq. link
On February 28, 1999, an article was written in The Kansas City Star which said, "He [bin Laden] has a private fortune ranging from $250 million to $500 million and is said to be cultivating a new alliance with Iraq's Saddam Hussein, who has biological and chemical weapons bin Laden would not hesitate to use. An alliance between bin Laden and Saddam Hussein could be deadly. Both men are united in their hatred for the United States....." link
On December 28, 1999, an article appeared in The Herald (Glasgow, Scotland) titled, "Iraq tempts bin Laden to attack West." The article starts, "The world's most wanted man, Osama bin Laden, has been offered sanctuary in Iraq....." The article quotes a U.S. counter-terrorism source who said, "Now we are also facing the prospect of an unholy alliance between bin Laden and Saddam. The implications are terrifying." link
On April 8, 2001, an informant for Czech counter-intelligence observed an Iraqi intelligence official named al-Ani meeting with an Arab man in his 20s at a restaurant outside Prague. Following the 9/11 attacks, the Czech informant who observed the meeting saw Mohammed Atta’s picture in the papers and identified Mohammed Atta as the man who met with the Iraqi intelligence official. link link link
Able Danger, a highly-classified U.S. Army intelligence program under the command of the U.S. Army Special Operations Command, supports information from the Czech Republic’s intelligence service that Mohammed Atta meet with the Iraqi ambassador at the Prague airport on April 9, 2001. link link
On July 21, 2001 [less than two months prior to 911] the Iraqi state-controlled newspaper "Al-Nasiriya" predicted that bin Laden would attack the U.S. "with the seriousness of the Bedouin of the desert about the way he will try to bomb the Pentagon after he destroys the White House." The same state-approved column also insisted that bin Laden "will strike America on the arm that is already hurting," and that the U.S. "will curse the memory of Frank Sinatra every time he hears his songs" - an apparent reference to the Sinatra classic, "New York, New York." link link link
After the 9/11 attacks, Saddam became the only world leader to offer praise for bin Laden, even as other terrorist leaders, like Yassir Arafat, went out of their way to make a show of sympathy to the U.S. by donating blood to 9/11 victims on camera. Saddam later pays tribute to 9/11 by having a mural painted depicting the World Trade Center attack at an Iraqi military base in Nasariyah.

New information reveals that House Speaker Nancy Pelosi was indirectly sending messages to the FARC. The Marxist Revolutionary Armed Forces of Colombia (FARC) is designated as a terrorist group by the US government. Speaker Pelosi was doing this while at the same time she refused to bring a free trade agreement with Colombia up for a vote in the US House. In fact, Pelosi took extraordinary steps to block this trade agreement with America's closest ally in South America.

Colombian Sen. Piedad Cordoba (left) is currently under investigation by the Colombian attorney general for ties to the FARC. Cordoba claims that Speaker Nancy Pelosi was sending messages to the FARC terrorists. Cordoba also claimed during FARC negotiations that Pelosi had assigned Rep. Jim McGovern, as the point man. Captured FARC documents confirmed in March that Mr. McGovern had been working with an American go-between, who had been offering the rebels help in undermining Colombia's elected and popular government.
The Wall Street Journal reported on the confiscated FARC documents that implicated Rep. McGovern back in March:
Now, today we find out who was directing Rep. McGovern--The Reyes hard drive reveals an ardent effort to do business directly with the FARC by Congressman James McGovern (D., Mass.), a leading opponent of the free-trade deal. Mr. McGovern has been working with an American go-between, who has been offering the rebels help in undermining Colombia's elected and popular government.
Mr. McGovern's press office says the Congressman is merely working at the behest of families whose relatives are held as FARC kidnap hostages. However, his go-between's letters reveal more than routine intervention.

Last fall, Mr. Chávez and the FARC hatched an audacious plan whereby the Venezuelan would take "proof of life" of Ms. Betancourt to French President Nicolas Sarkozy in Paris, where the plight of Ms. Betancourt was a cause célèbre. The rebels wrote that Mr. Chávez was sure French pressure for negotiations would cause President Bush to "order Uribe to allow the meeting" between Mr. Chávez and the rebels on Colombian soil, something Mr. Uribe had refused to do. The rebels reported that Mr. Chávez was "super-motivated," because he viewed the rendezvous as a public-relations coup that would give him and the FARC "continental and world renown."
That plan flopped, but Mr. Chavez had other cards up his sleeve. One involved Colombian Sen. Piedad Cordoba, who is currently under investigation by the Colombian attorney general for ties to the FARC. She figures prominently in the captured rebel documents, and is notoriously close to Mr. Chávez.
She met at the Venezuelan presidential palace with FARC leaders last fall. From that meeting the rebels reported that "Piedad says that Chávez has Uribe going crazy. He doesn't know what to do. That Nancy Pelosi helps and is ready to help in the swap [hostages in exchange for captured guerrillas]. That she has designated [U.S. Congressman Jim] McGovern for this."
If the speaker of the House was working with Ms. Cordoba in this scheme, her judgment was more than a little misguided. The rebels write that on a trip to Argentina Ms. Cordoba told them, "It doesn't matter to me the proposal that Sarkozy has made to free Ingrid. Above all, do not liberate Ingrid." In short, why give up such a useful pawn?

Brining Down the Veil of Secrecy
Have you ever spoken to an elected official and left the encounter with the distinct impression that he/she no longer represented the people but had instead become a status-quo politician? Sometimes you can almost see "government as usual" in their eyes as they make the excuses that indicated they are now part of the problem and not the solution. A few months ago, I was asked to define the tipping point when an elected official makes that leap from representing the people to representing the status-quo (becoming "one of them"). This has inspired me to develop a checklist, a set of clearly definable principles, that I believe differentiates between those who have become defenders of the system and those who are still part of the people living under the system.
One of the most important components on this list is that of enabling more government transparency. Defenders of the government as usual system will make up excuses for why people are not allowed to see what is going on in government. Representatives of the people will work hard to institute new ways of allowing the people to see and understand what is happening.
Because of the tremendous size of government, there are now countless boards and commission spending billions of our taxpayer dollars with little oversight from the people. Today, most people are so tied down with the necessities of life, work, family, church, etc., that they have little time to attend the countless number of meetings where their money is being spent. They are forced through no fault of their own to blindly trust these boards and commissions to do the right thing even though hardly anyone is there to watch them work.
I have felt the answer to this problem is televised government and made it a top issue as Guthrie City Councilman. The Council agreed to televise meetings on Guthrie's public service television channel and, thanks to the work of Lance Crenshaw, the Guthrie telecast is probably one of the best in the state. The Council also approved a policy to allow other government entities to provide recordings of their meetings to the Guthrie public service channel as well.
As State Representative, one of my biggest policy initiatives has been to work on televising state government proceedings. I am optimistic that this effort will meet with success.
In addition to televising state government, I believe it is time to look at requirements for those public entities who have public service television channels, such as school boards and city government. I believe these entities should, at the very least, televise video recording of their meetings. With the minimal cost of a video/digital recorder, there is no longer any valid reason for them to keep the public in the dark.
Several years ago, by a one vote margin, both the Logan County Board of Commissioners and the Logan County Medical Center Public Trust (both of which vote on spending millions of taxpayers dollars) voted not to produce and play videos of their meetings on the Guthrie public service channel. I hope both boards will revisit this unfortunate decision, as I feel those who truly represent the people should never fear public disclosure.

Conservative leader and writer Michael Johns, a former White House speechwriter and Heritage Foundation foreign policy analyst, said last night that the United States needs to act with great urgency to secure its southern border with Mexico if it hopes to protect the nation's security interests and begin reversing the many economic and other crises spurred by the nation's apparent unwillingness to enforce federal immigration laws by fully securing its southern border.

In the interview, Johns challenges the conventional wisdom that Mexico's illegal aliens in the U.S. are only filling jobs that Americans do not want, stating that nearly half of them--10.5 million of the 21.6 million illegal Mexicans in this nation--are illegally filling skilled jobs that almost certainly would be appealing to Americans at a time when unemployment is standing at 5.5 percent nationally. Johns stated further that the failure of the U.S. to seal its southern border from illegals represents one of the greatest ongoing security threats to the nation at a time when the U.S. continues to be embroiled in a global conflict against al-Qaeda and Islamic extremism.
Johns stated that the 21.6 million illegal Mexican aliens in the U.S. are ill-serving the U.S. economy, costing the nation approximately $397 billion annually in education, health care and other social services. Meanwhile, Johns says, Mexican illegals are returning large sums of their earnings--approximately $33 billion annually to Mexico and $283 billion annually to all of Latin America. He also said that the U.S. has spent approximately $1.5 billion since 2001 in costs associated with the incarceration of approximately 370,000 illegal aliens in the U.S.
As President of Phoenix's Coalition for a Conservative Majority (CCM), Johns and his organization are actively supporting two Arizona ballot initiatives that would strengthen the state's illegal immigration enforcement capabilities by empowering Arizona's law enforcement officials to enforce federal immigration laws and make the state's criminal trespass statutes applicable to illegal aliens in the state. The deadline for the submission of signatures for these two ballot initiatives is this Thursday, July 3, 2008.
